ලලිත් සහ කුගන් සහෝදරවරු දෙදෙනා පැහැරගෙන අතුරුදන් කිරීම සම්බන්ධයෙන් පෙරටුගාමී සමාජවාදී පක්ෂය පැවරූ නඩුව අද යාපනය මහේස්ත්රාත් අධිකරණයේ විභාගයට ගැනීමට නියමිතය. හිටපු ජනාධිපති ගෝඨාභය රාජපක්ෂ එම නඩුවට අදාලව මාර්ගගත ක්රමයට සාක්ෂි දීම සඳහා අද කොලඹ අලුත්කඩේ අධිකරණ සංකීර්ණයට පැමිණියේය. ඔහුට සියළු අතුරුදන් කිරීම් පිලිබඳ සත්යය හෙලිකරන ලෙස බලකරමින් අද, සැප්තැම්බර් 29 පෙරවරු 10.00ට අලුත්කඩේදී නිහඬ උද්ඝෝෂණයක් සංවිධානය කර තිබිණි. එහිදී අදහස් දැක්වූ පෙරටුගාමී සමාජවාදී පක්ෂයේ අධ්යාපන ලේකම් පුබුදු ජයගොඩ,
“ලලිත් කුමාර් වීරරාජු සහ කුගන් මුරුගානන්දන් සහෝදරවරු දෙදෙනා 2011 දෙසැම්බර් 9 වැනිදා ආරක්ෂක හමුදා පාලනය යටතේ තිබූ යාපනය අධි ආරක්ෂිත කලාපයකදී පැහැරගෙන අතුරුදන් කරනු ලැබුවා. ඊට පසු සතියේ පැවති කැබිනට් මාධ්ය හමුවේදී එවකට කැබිනට් මාධ්ය ප්රකාශක කෙහෙලිය රඹුක්වැල්ල ප්රකාශ කළා ඔවුන් දෙදෙනා සිටින්නේ අත්අඩංගුවේ බව. ඔවුන් අධිකරණයකට ඉදිරිපත් කරන බවත් ඔහු පැවසුවා. නමුත් වසර 16ක් ගතවුණා, ලලිත් සහ කුගන් ගැන කිසිදු ආරංචියක් නෑ. අපි 2011දී අභියාචනාධිකරණයේ ඔවුන් දෙදෙනා සිටින තැන හෙලිදරව් කරන ලෙස ඉල්ලා හබයාස්කෝපුස් පෙත්සමක් ගොනු කළා. එහි විමර්ශන කටයුතු අභියාචනාධිකරණය විසින් යාපනය මහේස්ත්රාත් අධිකරණයට යොමු කළා. යාපනය මහේස්ත්රාත් අධිකරණයේ සාක්ෂි දුන් කෙහෙලිය රඹුක්වැල්ල පැවසුවේ තමන් කැබිනට් මාධ්ය හමුවේ එලෙස පැවසුවේ එවකට ආරක්ෂක අමාත්යංශ ලේකම් ගෝඨාභය රාජපක්ෂ දුන් උපදෙස් අනුව බව. ඒ අනුව 2019 අප්රේල් මාසයේදී මේ සම්බන්ධයෙන් සාක්ෂි දීමට අධිකරණයේ පෙනී සිටින ලෙස යාපනය මහේස්ත්රාත් අධිකරණය නියෝග කළා. එතැන් සිට වසර හතහමාරක් ගෝඨා අධිකරණයෙන් කට්ටි පැන්නා. අපි පෙරටුගාමී සමාජවාදී පක්ෂය දිගින් දිගටම කළ අරගලයේ ප්රතිඵලයක් ලෙස අද ඔහුට කොළඹ අධිකරණයකට පැමිණ මේ අපරාධ ගැන කට උත්තර දීමට සිදුව තිබෙනවා.
මෙය ඓතිහාසික වන්නේ වසර 16කට පසු හිටපු ජනාධිපතිවරයෙක් සාක්ෂි කූඩුවට නැංවීමට පෙරටුගාමී සමාජවාදී පක්ෂය සමත්වූ නිසා පමණක් නෙවෙයි. රාජපක්ෂ ආණ්ඩුවම පත්කළ මැක්ස්වෙල් පරණගම කොමිෂන් වාර්තාවේ අතුරුදන් කළ 25,000කගේ නම් තිබෙනවා. ඇමිනෙස්ටි ඉන්ටර්නැෂනල් වාර්තාවේ බලහත්කාරයෙන් අතුරුදන් කළ 30,000කගේ නම් තිබෙනවා. ඒ කිසිවකට යුක්තිය ඉටුවී නෑ, අවම වශයෙන් නෛතික ක්රියාමාර්ග නෑ. ලලිත් කුගන් නඩුව තමයි සක්රියව පවතින එකම නඩුව. මේ සියලු අපරාධ වලට වගකිවයුතු ගෝඨාට මේ ගැන දැන් උත්තර දීමට සිදුවෙනවා. අපි ලලිත් කුගන් අතුරුදන් කිරීම පමණක් නොව මේ සියල්ල ගැන විමසනවා. මේ අපරාධ වලට යුක්තිය ඉටු කිරීමේදී සිදුවු දෑ පිළිබඳ සත්යය හෙලිදරව් කිරීම, වගකිවයුත්තන්ට දඬුවම් දීම, අනාගතයේදී එවැනි දේ නැවත සිදුවීම වැළැක්වීම යන සියල්ල වැදගත්. අපි ඒ වෙනුවෙන් අඛණ්ඩව නෛතික ක්ෂේත්රයේ වගේම ජාතික – ජාත්යන්තර උද්ඝෝෂණ, ප්රචාරක, දේශපාලන ක්ෂේත්ර වල අරගල කරනවා. අනාගතයේදී ලංකාවේ කිසිම පුරවැසියෙකු මේ ආකාරයෙන් අතුරුදන් නොවන තත්වය නිර්මාණය කිරීමට අප කැපවෙනවා.”
The Frontline Socialist Party’s case over the abduction and disappearance of comrades Lalith and Kughan is due to be heard today at the Jaffna Magistrate’s Court. A silent protest was scheduled for 10:00 a.m. today, September 29, at Aluthkade, calling on former President Gotabaya Rajapaksa to reveal the truth about all disappearances. He came to the Aluthkade court complex in Colombo today to give evidence remotely in connection with the case. Speaking at the protest, Frontline Socialist Party Education Secretary Pubudu Jayagoda said the case is important because it is still moving forward after many years.
“Comrades Lalith Kumar Weeraj and Kughan Muruganandan were abducted and disappeared on December 9, 2011, in a high-security zone in Jaffna under the control of the security forces. At a Cabinet press briefing the following week, then Cabinet spokesperson Keheliya Rambukwella said the two men were in custody and would be produced before a court. But 16 years have passed, and there has been no word about Lalith and Kughan,” he said.
In 2011, we filed a habeas corpus petition in the Court of Appeal seeking disclosure of their whereabouts. The Court of Appeal referred the matter to the Jaffna Magistrate’s Court. At the hearing, Keheliya Rambukwella said he had made the statement at the Cabinet press briefing on the instructions of Gotabaya Rajapaksa, then Secretary to the Ministry of Defence. Accordingly, in April 2019, the Jaffna Magistrate’s Court ordered Gotabaya Rajapaksa to appear and give evidence in the case. He did not appear before the court for the next seven and a half years. As a result of the Frontline Socialist Party’s ongoing campaign, he appeared before a court in Colombo today and answered questions about these allegations.
“This is historic not only because it is 16 years later, but because the Frontline Socialist Party has brought a former president to the witness stand. The Maxwell Paranagama Commission, appointed by the Rajapaksa government itself, listed 25,000 people who had disappeared. An Amnesty International report listed 30,000 people who had been forcibly disappeared. None of these cases has seen justice—or even, at a minimum, legal action. The Lalith–Kughan case is the only one still proceeding. Gota, who is linked to these cases, now has to answer questions about them.”
“We are asking questions not only about the disappearances of Lalith and Kughan, but about all these cases. To pursue justice in these cases, it is vital to reveal the truth about what happened, punish those responsible, and prevent such things from happening again. We will continue our struggle in the legal arena, as well as through national and international protests, campaigns, and political action. We are committed to creating a situation in which no citizen of Sri Lanka will ever again be disappeared in this way,” he said.
