Abduction of comrades Lalith Kumar Weeraraj and Kuhan Murngansan who were the members of the FLSP is one of the fundamental democratic and human rights violations in the country that occurred in 9th December 2011.
Two comrades were abducted and made to disappear involuntarily. The two abducted comrades have been at the forefront of a struggle fighting for tens of thousands people who have been disappeared or abducted. Also, they are fighting on behalf of political prisoners who continue to languish in detention camps. That is the primary reason for the disappearance.
The North and East areas, particularly in Jaffna, are militarized by the Mahinda Rajapaksa government. The entire area is under constant incidents such as arrest and detention cannot possibly occur without the knowledge of the military authorities.
The then Defence secretary Gotabhya Rajapaksha and the security authorities are collectively responsible for the abduction of Lalit and Kuhan. These shameful acts directly violate the democratic rights of the people, particularly the Tamil community’s aspirations.
After the abduction two Habeas Corpus writ applications were instituted in the Court of Appeal. The Court Of Appeal has directed the Magistrate Court of Jaffna to conduct an inquiry to find the facts and the two comrades’ whereabouts.
During the inquiry, credible facts were coming to the surface that the former Defense Secretary and current presidential candidate Gotabha Rajapaksha knew about the said abduction.
After that, the Magistrate Court of Jaffna has summoned him to appear on 3rd May 2019 whereas a lawyer appeared on his behalf and informed the Court it was not a convenient date to him. The Court granted another date namely 21st June 2019, and on the said date he submitted a medical report stating that he is not in a position to give evidence.
After that, the Court directed him to come to Court on 27th September 2019. Just three days before the inquiry he purportedly obtained an interim order from the Court of Appeal without notice to the other party staying the operation of the summons issued to him.
The Gotabhaya Rajapksha’s conduct shows he is the culprit of the abductions took place in the post-war period.
Front line Socialist party organized a protest and a press briefing in Jaffna to condemn this shameful conduct of the Rajapaksha and the Court’s bias stand.
